Are You Ready for the Generator Improvements Rule?

In November 2016, EPA issued a final rule making significant changes to the hazardous waste generator regulations. One of the primary objectives of this rule was to reorganize the regulations to make them more user-friendly, which should improve compliance. The rule, known as the “Generator Improvements Rule” or “GIR,” also addressed gaps in the regulations to strengthen environmental protection and provided greater flexibility for generators to manage their wastes in a cost-effective and protective manner. The rule went into effect on May 30, 2017 in a few states and, in general, must be adopted by all states by July 1, 2018.

The major provisions of the GIR include:

  • More emphasis on hazardous waste determinations,
  • New labeling requirements for hazardous waste tanks and containers,
  • Additional preparedness and prevention and contingency planning requirements,
  • Satellite accumulation containers must now be included in contingency plans,
  • New rules for “episodic generation,” and
  • Very small quantity generators (formerly CESQGs) can ship hazardous waste to large quantity generators controlled by the same person or company.

This presentation will provide context to help the audience better understand the new rules. It will offer practical insights and suggestions on how to comply. Our presenter will address the new rules in detail and from an operational rather than a legalistic perspective. We’ll conclude with a checklist of specific steps to take to be sure you are in compliance with the new requirements.
